Interim Final Rule on Mental Health Parity
The Departments of Health and Human Services, Labor and Treasury released an interim final rule implementing the Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act (the “MHPAEA”) on February 2, 2010. It is anticipated that the regulators will finalize the rule sometime after a 90-day comment period. Most health plans will have to meet the requirements of this new regulation for plan years beginning January 1, 2011, but in the meantime they must continue their “good faith” compliance with the law.

Medicare Payment Changes Q & A
In the update on the 2010 medicare fee schedules, psychologists will see payment amounts in the 2010 fee schedules posted by their Medicare Administrative Contractors (MACs) that are considerably lower than 2009.
The Center for Medicare and Medicaid Services (CMS) recently released its final rules on the 2010 fee schedule. The rule includes changes to Medicare payments for the practice expense of all covered services, including those commonly billed by psychologists.
